 The City of Jonesboro Mayor and Council held a regular council meeting on September 13, 2004 at 7:00pm.  The meeting was held at 170 South Main Street.

Minutes Approved
:  Councilman Norrington motioned, seconded by Councilman Yonce to approve the August 9, 2004 minutes as written.  The motion carried with Councilman Sewell abstaining as he was not at the meeting. 

Councilman Sewell made a motion to approve the minutes of the August 21, 2004 Called Meeting as written.  Councilman Norrington seconded.  The motion carried unanimously.

Old Business:

Rezoning Request 198 N. McDonough St.:  Mayor Day announced that a public hearing has been held regarding this rezone, however additional comments on this rezone request will be heard at this time.  Attorney Steve Fincher spoke on behalf of the Turner family.  He presented council with a revised package.  Multi Specs Developer addressed the council and explained that a proposed Victorian Style development with home prices from 160K and up would sell in this area.  Eloise Greene (N. McDonough St.) spoke of her opposition to the rezone proposal and presented the council with a petition.  David Brooks (N. McDonough St.); Beverly Swint (N. McDonough St.); Larry Boak (Stockbridge Rd); Leroy Jones (Starr Dr); Antonio Evans (Irvin St.) and JoAnn Chavez (Ingleside Dr.) all spoke in opposition of this development.  Attorney Steve Fincher spoke of the changes taking place in Jonesboro and reviewed the LCI study specifically the density and how this development would be an asset to the downtown development area.  He spoke about the planning staff recommendations/conditions and the willingness of the developers to meet the conditions excluding the all brick homes.  Mayor Day asked if Multi Specs had built the homes that were presented in the packet and Councilman Norrington had questions on the lot sizes.  Multi Specs had not build the homes pictured in the packet and the lot sizes were discussed. Mayor Day asked if Mr. Fincher had anything else to add as he still had time.  He did not.  Mayor Day called for motion.  Councilman Yonce made a motion to deny this rezone request from Residential to RS7.  Councilman Norrington seconded.  The motion carried unanimously.

Home Occupation Request:  Amy and Barry Wingler of 122 Stewart Avenue requested a home occupation to operate a Computer Internet Service and Consultant business.   They advised the council there would be no outside advertisement except on his vehicle and work would be on client sites.  Councilwoman Meadows motioned to approve this home occupation request.  Councilman Sewell seconded.  The motion carried unanimously.

Church Bells at St. Frances:  Arthur Morrison and Tom Bennett requested council to consider having church bells/music played at 9am/12noon/3pm at St. Francis Church on North Main Street.  Mayor Day played the CD for the council to hear.  Councilman Sewell motioned to allow the church a six-month trail period to play the music at 9am/12noon/3pm and at the end of six months review to see if any changes need to be made.  Councilman Yonce seconded.  The motion carried unanimously.

New Business:

Home Occupational License:  Hazel Utley requested a home occupation at her primary residence 222 N. McDonough Street to provide real estate and business consulting services.  She stated she does have a Realtors license and has experience as a loan processor.  There would be no outside advertisement at this location and the service would be provided at the client’s location.  Councilman Yonce motioned to approve this request for a home occupation.  Councilman Norrington seconded.  The motion carried unanimously.

Sign Regulations/Zoning Ordinance:  Mayor Day asked for questions or comments regarding this ordinance. Councilwoman Meadows made a motion to approve the Sign Regulation in the Zoning Ordinance as presented.  Councilman Yonce seconded.  The motion carried unanimously.

Sign Regulations Licensing Ordinance:  Mayor Day asked for any comments or questions regarding this ordinance.  Councilwoman Meadows motioned to approve the Sign Regulations Ordinance as presented.  Councilman Norrington seconded.  The motion carried unanimously.

Alcoholic Beverage Ordinance:  Councilman Sewell motioned this ordinance be tabled for further study as the council has just received a final draft of the ordinance and to have a called meeting or to discuss at the next meeting.  Councilman Norrington seconded.  The motion carried unanimously.  City Manager Jon Walker asked the council for feedback regarding any changes or additions to this ordinance.

Court Order Condemnation Budget:  City Manager Jon Walker reviewed the court order pertaining to 271 North Main Street.  This is an estimated budget and would be a separate budget from the general fund so that all expenses can be recouped. Councilman Sewell asked if there were any liens on the property.  Attorney Webb stated there was sufficient equity to proceed.  Councilman Sewell made a motion to approve this condemnation budget not to exceed $102,000.  Councilman Yonce seconded.  The motion carried unanimously.

City Inspectors: City Manager Jon Walker requested the council consider contracting with Municipal Building Inspection Service/James Miley for building inspections, with FireMark Services for fire inspection and PBS&J to cover any inspections on a as-needed basis.  The fees would be half of the permit cost, and would include Certificate of Occupancy inspections.  PBS&J and Fire Mark have given fee schedules.  The fees are to be paid by the permit holder.  Councilwoman Meadows motioned to accept this proposal for inspections services as presented by the City Manager.  Councilman Norrington seconded.  The motion carried unanimously.

Executive Session:  Mayor Day asked for a motion to go into Executive Session to discuss real estate and personnel.  Councilman Sewell motioned seconded by Councilman Norrington to go into Executive Session.  The motion carried unanimously.

Councilman Sewell motioned, seconded by Councilman Norrington to resume regular session.  The motion carried, regular session resumed.

Other Business:

Travis Cantrell (Fayetteville Rd) requested the council consider street parking temporarily during First Baptist Church Services on Sunday mornings. Councilman Norrington made a motion to approve First Baptist Church parking on the south side of Church Street as far down as the church daycare playground and parking on the west side of Riley Way on Sunday morning during church services until the lot is ready on West Mill Street.  Councilman Sewell seconded.  The motion carried unanimously.

Bobby Wiggins (W. Mimosa St.) requested information as to why the city needs a finance officer.  He was referred to the city manager.  Councilwoman Meadows asked if the council had voted on hiring a finance officer.  Mayor Day and City Manager reminded Councilwoman Meadows it has been discussed. 

Mayor Day read a resolution to purchase property behind Heritage Bank and allowing Heritage Bank 30 parking spaces.  Mayor Day asked for any discussion.    Mayor Day asked for a motion to approve this resolution.  Councilman Sewell so motioned.  Councilman Norrington seconded.  The motion carried unanimously.

Councilman Yonce asked about the property development behind South Avenue and the curb cut not permitting the residences the use of their property.  In addition he asked if the code enforcement had been notified of two swimming pools on South Avenue.  Mayor Day informed Councilman Yonce that the code enforcement officer is aware of the swimming pools.

There being no further business, Councilman Sewell motioned to adjourn.  Councilman Meadows seconded.  The motion carried and the meeting was adjourned.
