Regular Meeting
October 11, 1999


The regular meeting of Mayor and Council was held October 11, 1999 at 170 South Main Street. Mayor Day and members were present as follows: T. E. Adair, Richard Jester, Yvette McDonald, Wallace Norrington and Clifford Sewell; Shirley Wynn was absent.

The minutes of the September meeting were read and approved with the correction of the time of the Red Ribbon Parade. This was corrected from 8:30 a.m.to 9:30 a.m.

On a motion by Sewell, seconded by Norrington, the Personal Care Home Ordinance was postponed. The motion carried unanimously.

Having been properly posted and advertised, a hearing was held concerning the rezoning of the property behind the courthouse at Arnold Street from R-2 to R-3. David Harris spoke on behalf of the applicant, Henry A. Lassiter Estate. A petition was presented to Council from residents in the area objecting to the rezoning request; also, Ms. Lurline Newton addressed the Council and expressed opposition to the request. Jester moved, seconded by Sewell, that the rezoning request be denied. The motion carried unanimously.

Jester moved, seconded by Norrington, that no action be taken on the request of Linda Vickery to open a Flea Market/Mall at 8160 Tara Blvd due to her absence and this be postponed until she can be present. The motion carried unanimously.

Norrington moved, seconded by Jester, that the Gas Aggregation Agreement be postponed upon the recommendation of City Attorney, Murray Weed. The motion carried unanimously.

On a motion by Sewell, seconded by Adair, it was unanimous to allow Mr.and Mrs. Rainer to build an apartment on the back of their lot at 145 College Street. The motion carried unanimously.

Sewell moved, seconded by Norrington, that Lizzie Souder be allowed to rebuild her burned home on Mill Street to be located on the lot as it stood previously. The motion carried unanimously.

Mr. Justin Morris was present requesting that his wrecker service be used by the City as back-up . Sewell moved, seconded by McDonald that he inspect the present contract to determine if he can meet all the requirements as stated and report and consult with Chief Montgomery. The motion carried unanimously.

On a motion by McDonald, seconded by Jester, the request of Hardee's to replace their signs at 121 Highway 54 was postponed until other plans are submitted and the Council can view ones that have been erected in another location. The motion carried unanimously.

Sewell moved, seconded by McDonald, that the rezoning application fee be increased from $50 to $200 which would cover all the expense involved with posting and advertising. The motion carried unanimously.

On a motion by Sewell, seconded by Adair, the expenditure of $25,200 was authorized as recommended by the Y2K committee for generators and a mobile repeater radio system for the fire department. The motion carried. For the motion were Adair, Jester, McDonald and Sewell; McDonald abstained.

Mr. Massengale reported to Council that a lift is being installed at the maintenance lot for working on vehicles. He also reported that there have been problems at the cemetery with identifying lots according to the map that was submitted when it was purchased and suggested that it be surveyed and marked to avoid further confusion. Mayor Day suggested that this be taken up at a work session.

On a motion by Sewell, seconded by Norrington, the Fire Department was authorized to spend $10,000 on SCBA equipment as included in the present year budget. The motion carried unanimously. Chief Wiggins presented the City with a check from Dekalb County as a portion received from FEMA for the department's assistance during a storm in that area.

Councilman Adair suggested that the carport at City Hall be enclosed for a storage area rather than enclosing and area in the attic for that purpose. It was agreed to give this further consideration.

There being no further business, Adair moved, seconded by Norrington that the meeting be adjourned.
