Regular Meeting
March 10, 2003

The regular meeting of the Jonesboro Mayor and Council was held Monday, March 10, 2003 at 7:00 pm, at 170 South Main Street.

Mayor Day began the meeting with the Pledge of Allegiance.   

Minutes:  On a motion by Councilman Maddox, seconded by Councilman Sewell, minutes of the February 10, 2003 meeting was approved as distributed. 

Adult Entertainment Ordinance #03-05:  Mayor Day asked for any comments regarding the Adult Entertainment Ordinance. Councilman Sewell made a motion, seconded by Councilman Norrington to approve the Adult Entertainment Ordinance as written. The motion carried. 

Rezoning Request 236 South Main Street:  Mayor Day asked the Executrix Carolyn Crumley if she would like to speak to the council.  Ms Crumley declined.  Councilman Maddox requested the buffer between residential and commercial area be maintained.  Councilman Sewell requested a maintained privacy fence be in place on the commercial property between the adjoining residential properties. Councilman Maddox made a motion, seconded by Councilman Yonce to approve the rezoning request for 236 South Main Street from R-2 (Residential 2) to C-1 (Commercial-1) with the stipulation that it has a buffer.  The motion carried. 

Home-based Occupational License David Murphy, 138 Cecilia Circle:  Mr. Murphy was not present at council meeting.  Councilman Sewell made a motion, seconded by Councilman Norrington, to withdraw the request from the agenda.  The motion carried. 

Home-based Occupational License, Sonya Dyess, 217 Wallis Street:  Mrs. Dyess was not present, her husband was.  Mayor Day explained, the applicant Sonya Dyess needs to be present.  Mr. Dyess was given the opportunity to bring Mrs. Dyess to the meeting. He did not return.  On a motion made by Councilman Sewell seconded by Councilman Maddox Mrs. Dyess’ request for home-based license was tabled for the April meeting. The motion carried. 

GMEBS Retirement Adoption Agreement:  Mayor Day advised this adoption agreement would bring the city’s retirement plan into compliance with the new IRS laws.  Councilman Maddox motioned, seconded by Councilman Adair to approve the GMEBS Retirement Agreement as written. The motion carried. 

Executive Session: Mayor Day requested a motion to go into Executive Session to discuss personnel, legal matters and possible land acquisition.  Councilman Norrington so motioned, seconded by Councilman Yonce.  The motion carried. 

Councilman Sewell made a motion, seconded by Councilman Norrington, to resume regular council meeting. The motion carried.  Regular session was resumed. 

Appointment of City Attorney:  Councilman Maddox made a motion, seconded by Councilman Norrington, to appoint the firm of Smith, Welch & Brittain as City Attorney.  The motion carried. 

Public Comments:

Dan Astin addressed the council with the following concerns:

·        Traffic on Church Street/possibility of stop sign placement or
a No Thru Traffic sign, possible usage of speed limit machine.

·        General code enforcement issues, i.e. house on Stewart Ave. 

Ed Brown addressed the council regarding the possible rezoning/development of approximately 10 acres on North McDonough Street.  He explained the development of Fee Simple Town-Homes, sidewalks, street lights with the Turner home possibly being rezoned to O&I.  Mr. Brown was referred to City Manager Jon Walker and Mayor Day. 

On a motion by Councilman Sewell, seconded by Councilman Norrington the meeting was adjourned.
