CITY COUNCIL MINUTES
DECEMBER 8, 2003

The regular meeting of the Jonesboro Mayor and Council was held at December 8, 2003 at 7:00 pm, at 170 South Main Street.

Members Present: Councilman Ed Adair

                             Mayor Joy Day

Staff Present: Sam Durrance, Interim Public Works Director

                     Jimmy Wiggins, Fire Chief

Mayor Day began the meeting with the Pledge of Allegiance.

Minutes: Councilman Sewell motioned, seconded by Councilman Maddox to approve the November 10, 2003 minutes as written. The motion carried unanimously. Councilman Norrington motioned, seconded by Councilman Yonce to approve the November 14 & 15 Retreat Minutes. The motion carried. Councilwoman McDonald motioned to approve the December 1, 2003 Budget Hearing. Councilman Adair seconded and the motion carried unanimously.

Storage Variance: Under old business, John McMillan presented additional information regarding outside storage containers for his property on South Main St. (Clayton Salvage). No action was taken and the request died for lack of motion from the council.

Award presentation: Fire Chief Jimmy Wiggins and Mayor Day presented Willis Swint, long time resident and active city fire fighter with a proclamation and special Fire Chief patch and jacket for his years of dedicated service to the city and community.

Home Occupational License: Hach Chrouk, 112 Elaine Terrace requested an additional home occupational license to operate as a Seamstress. Councilman Maddox made a motion, seconded by Councilman Adair to issue Mrs. Chrouk an occupational license. The motion carried.

Home Occupational License: Luther Maddox, 106 Woodhaven Drive to operate a Consulting Business. Councilman Sewell motioned, seconded by Councilwoman McDonald to approve this home occupational request. With Councilman Maddox abstaining, the motion carried.

Game Room Regulation Ordinance: Councilman Maddox made a motion to approve the Game Room Regulation Ordinance as presented. Councilman Norrington seconded. The motion carried unanimously.

Nuisance Abatement Amendment: Attorney John Webb reviewed the procedures in amendment. Councilman Sewell motioned, seconded by Councilman Yonce to approve the Nuisance Abatement Amendment as presented. The motion carried unanimously.

Employee Insurance Resolution: This resolution gives the employees an option between HMO and PPO insurance coverage. Councilman Sewell motioned, seconded by Councilwoman McDonald to approve the Employee Insurance Resolution. The motion carried unanimously.

2004 Budget: City Manager reviewed budget changes with council and explained the budget does include an employee list. Councilman Sewell motioned to approve the 2004 Budget of $3,638, 613 as presented. Councilman Norrington seconded. The motion carried unanimously.

Police SOP Booklet: Councilman Maddox motioned, seconded by Councilman Sewell to table any action on this Police Standard Operating Procedures booklet until the Mayor and Council has time to review. The motion carried unanimously.

Post/Publish Meeting Notices: Councilman Sewell motioned, seconded by Councilman Norrington to approve the listing of 2004 Council Meetings to be published and posted. The motion carried unanimously.

Under other business Mayor Day requested the addition of an Occupation Tax Ordinance and a Solid Waste Collection Ordinance with a separate motion to consider an Executive Session to discuss personnel matters and pending litigation. Councilwoman McDonald made a motion to add Consideration of an Occupational Tax Ordinance and a Solid Waste Collection Ordinance to the agenda. Councilman Yonce seconded and the motion carried.

Occupational Tax Ordinance: Attorney John Webb reviewed the Occupational Tax Ordinance. Councilman Maddox motioned, seconded by Councilwoman McDonald to approve this Occupational Tax Ordinance as presented. The motion carried unanimously.

Solid Waste Collection Ordinance: Councilman Sewell motioned, seconded by Councilman Norrington to approve the ordinance as presented. The motion carried with Councilman Maddox voting no. Mayor Day noted that discussions were held regarding revenue suggestions and no suggestions were made by anyone on ways to raise revenues during the budget hearing process, which included open meetings and the recent retreat. No changes, additions or corrections to the budget regarding this issue.

Executive Session: Mayor Day requested a motion to go into Executive Session to discuss personnel matters and pending litigation. Councilwoman McDonald so motioned, seconded by Councilman Adair. The motion carried unanimously.

Councilman Maddox motioned, seconded by Councilman Norrington to resume regular session. The motion carried unanimously.

There being no further business, Councilman Norrington motioned seconded by Councilwoman McDonald to adjourn the meeting. The motion carried.
