Regular Meeting
August 13, 2001

The regular meeting of Mayor and Council was held August 13, 2001. Present were: Rip Sewell, Wallace Norrington, Luther Maddox, Yvette McDonald, Rick Yonce, Ed Adair with Mayor Day presiding.

The July minutes were read and unanimously approved.

Mayor Day asked council to delete items 13 & 14 from the agenda, as the information was not available for review. Sewell motioned to delete these resolutions, seconded by McDonald. The motion carried unanimously.

Susan Hambrick, 199 North Main Street, requested Mayor and Council's opinion as to her property being rezoned from O&I to CH church zoning. Sewell voiced concern about the parking area, McDonald voiced concern about when this small church grew, what would happen later on. McDonald suggested Ms.Hambrick request a rezoning and have it properly advertised then the council would be able to hear any resident's concern. Susan Hambrick thanked the council for their input.

Sewell motioned, seconded by Norrington, to move the following to the end of the agenda, as no one was present to address the council:
     Building permit requested for property at the corner Burnside & Cloud Streets.
     Alva Wisdom - 124 Ingleside Drive - Variance request for canopy.
     Tom Scott - request to lease fire station on West Mill Street.

The motion carried unanimously.

Ana Gutienez  requested a home occupation business license at 145 South McDonough Street for a party/event planner. She will have no cooking at the apartment and will be using her van for transportation. Sewell voiced concern over the lease agreement with the manager of the complex. He made a motion to approve this request contingent upon the management of Keystone Apartments approval and a letter for them saying it was permitted. Yonce seconded and the motion carried unanimously.

Edward Johnson, 180 White Line Street, commended the police department for the work in his neighborhood. Mr.Johnson advised council that he would like to purchase the abandoned roadbed that is on the end of his property. He would like to use this to extend his backyard to use for his dog kennel and storage building. The council had questions about the adjacent property ownership and the possibility of land locking their property. Sewell motioned to table this request until further study could be done. Wallace seconded. The motion carried unanimously. Mayor Day advised Mr.Johnson that she and Mr.Massengale would meet with him to look at his property and Mr.Norrington wants Mr.Clemmons to be contacted as he had shown interest in obtaining similar property.

Maddox made a motion to adopt the amended Soil & Erosion Ordinance as written. Sewell seconded. The motion carried unanimously.

Sewell motioned to authorize Mayor Day to sign LARP contracts regarding Old Morrow Road and College Street. McDonald seconded and the motion carried unanimously.

Chief Harris reviewed with the council the re-certification of city streets for the use of radar. Maddox voiced concern about the speed limit of 45 in the section of Jonesboro Road near the intersection of Hwy. 138 Spur and Jonesboro Road. Hw would like to see the speed dropped to 35. Chief Harris agreed to recheck that area, however because it is a state road the speed limit is assigned by the state. Maddox motioned to approve re-certification of streets for radar use as written. Norrington seconded. The motion carried unanimously.

Mayor Day requested the council to reconsider a pay increase for the public works department. She updated the council regarding the salary evaluations that will be in place soon. Sewell motioned to amend the current budget to increase the full time public works employees by 4%. He also wanted to say that with the pay increase, work expectation is to increase. McDonald seconded. The motion carried unanimously.

Mayor Day asked if anyone came to the council meeting late and wanted to be heard. Sewell motioned to delete the items moved to the end of the agenda afore mentioned due to the fact that no one appeared before council to voice their requests. Norrington seconded and the motion carried unanimously.

Code Enforcement Officer Wayne Rowland updated the council on problems that are being resolved. McDonald voiced concern about property that backs up to Dean Street but faces Lee Street. Sewell mentioned the former Fedack property, (North Main St.) and wants any swimming pool not in use to be checked for standing water due to the West Nile virus concern. Mayor Day advised that Fedack property was owned by Jack Brannan; he will be tearing down the building and improving his property. Chief Harris commended Councilman Sewell for his assistance in recent burglaries. He advised the council that the police department would like to have a neighborhood watch program when the Jodeco Park is dedicated.

Mayor Day asked if anyone present would like to speak. Cathy Roark, 246 North Lake Drive, addressed the council about lack of police presence on her street. She mentioned that she was aware of recent burglaries and wanted the council to be aware of the increase in traffic and speeders. Mayor Day asked Ms.Roark if she would be interested in assisting with a neighborhood watch and she agreed to help.

Mayor Day requested a motion to go into Executive Session to discuss litigation. Sewell motioned to go into executive session. Norrington seconded and the motion carried unanimously.

McDonald motioned to return to regular session. Norrington seconded. The motion carried.

Sewell requested that the door to the pump station storage building on Lee Street be repaired or boarded up. He asked that the two-story building at 104 Ingleside Drive, which was built for a garage, be check for occupancy. Occupancy would be in violation of the building and zoning code.

Sewell motioned to adjourn the meeting. Norrington seconded. There being no further business the meeting was adjourned.
